Terms and Conditions.

These terms and conditions (“Conditions”) outline how Georgia van Embden trading as Georgia van Embden Physiotherapyfrom Algo Business Centre, Unit 46, Glenearn Road, Perth PH2 0NJ (“we”, “us”, or “our”) provides physiotherapy and Pilates services to patients (“you” or “your”).

Please read these Conditions booking an appointment. By booking an appointment, you confirm that you understand these Conditions and that you are medically able to participate in physiotherapy or Pilates unless otherwise disclosed. You also confirm that all information provided during booking and assessment is accurate to the best of your knowledge. If you have any questions, please ask before your appointment.

1. Appointments and What to Expect

 1.1. Practitioner. All services are provided by Georgia van Embden, a Chartered Physiotherapist registered with the 

Health and Care Professions Council (HCPC) and a member of the Chartered Society of Physiotherapy (CSP).

Services may include:

• Musculoskeletal (MSK) physiotherapy assessment and treatment

• Female pelvic health assessment and treatment

• Manual therapy

• Dry needling

• One-to-one or group Pilates sessions

• Exercise prescription and rehabilitation

• Education

• Taping

• Online (telehealth) physiotherapy consultations.

We may also decline or discontinue treatment where it is not clinically appropriate or where your needs fall outside our professional scope of practice. In such cases, we will signpost or refer you appropriately.

1.2. Professional Standards. All assessment and treatment adhere to HCPC Standards of Conduct, Performance and Ethics and CSP Practice Standards. As an HCPC registrant, we are legally required to maintain accurate clinical records, obtain informed consent, act within our scope of practice, and ensure your safety throughout treatment

 

1.3. Appointment Duration

• MSK physiotherapy assessment: up to 45 minutes

• Pelvic health assessment: up to 60 minutes

• Pilates induction: 30 minutes

• Pilates class: 60 minutes

Follow-up sessions are generally 30 or 45 minutes, depending on clinical need.

 

1.4. During your Appointment.

 1.4.1. We will complete a full assessment, which may include questions about your symptoms, past treatment, medical history, lifestyle factors, and bladder/bowel/sexual function (for pelvic health care).

1.4.2. These questions help us understand your condition and guide treatment effectively. 

1.4.3. You may decline to discuss any topic that feels uncomfortable, and we will support you appropriately.

1.4.4. If we have concerns about your safety or wellbeing, we may signpost or refer you to relevant services (e.g., GP, specialist clinicians, charities, police) when appropriate.

1.4.5. Some assessments require partial undressing to observe movement, posture, or anatomy.

1.4.6. Pelvic health physiotherapy may include intimate examination when clinically appropriate. For women’s health assessments, when appropriate, vaginal and/or anorectal examinations may be indicated. These will only take place with your informed consent. We will explain the procedure, obtain your explicit consent, and youmay decline at any time.

1.4.7. Privacy and dignity will always be maintained.

1.4.8. You may decline any assessment or treatment at any time without prejudice.

1.4.9. For online consultations, we may not be able to assess or diagnose certain conditions due to limitations of remote assessment. You accept that outcomes may differ from in-person treatment.

1.4.10. You must inform us immediately if you experience pain, dizziness, emotional distress or any other unexpected symptoms during assessment or treatment.

1.4.11. You agree to follow reasonable clinical instructions to ensure your safety. Failure to do so may limit the effectiveness of treatment or require the session to be stopped. 

1.5. Treatment Plan. At the end of your assessment, we will discuss a personalised treatment plan, which may include physiotherapy, Pilates exercises, self-management strategies, onward referral, or further investigation. Treatment plans are recommendations only and do not guarantee a particular outcome. 

1.6. Between Appointments. You may receive exercises or advice to follow between sessions. You are not obliged to complete these, but your progress may be affected if you choose not to. You agree to inform us promptly of any change in symptoms or health conditions that may affect your treatment. You must also inform us of any changes in medication, medical conditions, pregnancy status, injuries or investigations prior to your next appointment.

2. Location of Services

Services may be provided at:

• Algo Business Centre, Unit 46, Glenearn Road, Perth PH2 0NJ.

• Perth Subud Centre, 7 St Leonard’s Bank, Perth PH2 8EB.

• Your home (domiciliary visit), by agreement. Please note that home visits may be refused if the environment is unsafe or unsuitable for treatment. When receiving treatment at home, you must ensure there is adequate space and a hazard-free area for exercises or assessments.

• Online via secure video consultation

Any alternative location must be agreed in writing.

  

3. Chaperone Policy

3.1. You may bring a chaperone to any appointment. Please inform us in advance. Patients under 16 must be accompanied by a parent or legal guardian.

3.2. A chaperone may also be required if you display behaviour that raises safeguarding or professional concerns.

3.3. We may request a chaperone if clinically appropriate, or we may reschedule if one is required and unavailable.

4. Risks and Benefits of Physiotherapy 

4.1. Before Treatment.  Before treatment begins, you must disclose any medical conditions, allergies, implants, injuries, medications, pregnancy or postpartum status that may affect assessment or treatment. Failure to do so may result in treatment being ineffective or unsafe.

4.2. Potential Benefits. Physiotherapy and Pilates-based rehabilitation may:

• reduce pain

• improve strength, mobility, and flexibility

• improve pelvic floor function and symptoms

• support recovery from injury

• restore activity, work, or sport participation

• enhance wellbeing and movement confidence.

Benefits vary from patient to patient and cannot be guaranteed.

4.3. Potential Risks and Side Effects. Physiotherapy is generally safe, but may involve:

• temporary soreness, discomfort, or fatigue

• mild bruising (e.g. from manual therapy, taping, or dry needling)

• temporary dizziness or light-headedness

• emotional sensitivity during pelvic health assessment

• rare risks with dry needling (e.g. minor bleeding, irritation, fainting)

• risk of muscle strain if exercises are not followed as instructed.

We will explain any relevant risks before treatment.

4.4. Dry needling. Dry needling carries additional risks which may include minor bleeding, temporary soreness, and rare but serious complications such as infection or pneumothorax. You will be verbally screened for contraindications prior to treatment.

4.5. Medical Concerns. If we identify symptoms requiring urgent or specialist medical review (e.g. neurological symptoms, severe trauma, red-flag signs), we will advise you to seek appropriate medical attention.

4.6. Your Role in Safe Care. You can support safe treatment by:

• informing us of any new symptoms or health conditions

• completing exercises as advised

• alerting us if anything feels uncomfortable or emotionally distressing

• asking questions at any time. 

4.7. Patient Understanding and Right to Withdraw. Physiotherapy aims to improve function, reduce pain, and support recovery, but outcomes cannot be guaranteed. Some treatments may cause temporary discomfort, soreness, or fatigue. You may withdraw your consent to any assessment or treatment at any time, and you may request referral to another healthcare professional if you feel this is appropriate.

 

5. Early Termination of a Session

5.1. We may refuse or discontinue treatment where we reasonably believe it is unsafe to proceed, including where you appear to be under the influence of drugs or alcohol or where your presentation requires urgent medical attention.

5.2. We may stop a session if you do not follow reasonable instructions required for safe treatment. The full session fee may still apply.

5.3. Aggressive, abusive, or inappropriate behaviour will not be tolerated and may be reported to Police Scotland. Where a session is terminated for safety or behavioural reasons, the fee for the session may still be charged in full.

 

6. Consent

6.1. You must inform us of any relevant medical conditions and provide informed consent for assessment and treatment.

6.2. Intimate Examinations. Pelvic health physiotherapy may include intimate examination when clinically appropriate. We will explain the procedure, obtain your explicit consent, and you may decline at any time.

6.3. Recording and Referrals. If clinical photographs, videos, or audio recordings are required, you will be asked for additional consent. Consent will also be requested before sharing reports or referrals with other health professionals, including your GP.

6.4. Consent is an ongoing process, and you may withdraw it at any time. However, withdrawal may mean that certain treatments cannot be continued.

6.5. Different treatments may require separate verbal or written consent, for example dry needling, internal pelvic examinations or the use of clinical photography.

7. Confidentiality

7.1. We are committed to maintaining your confidentiality and protecting your personal information in line with HCPC Standards, CSP guidance and UK GDPR. All information shared with us is treated as confidential unless disclosure is required by law or necessary to protect you or others from harm.

7.2. We may share relevant information with your GP or other healthcare professionals involved in your care, and we will normally seek your consent before doing so unless there is an immediate safeguarding risk or legal requirement.

7.3. Clinical notes are stored securely and form part of your clinical record. You may request access to them at any time. We may discuss aspects of your case anonymously in clinical supervision to ensure safe and effective practice.

7.4. If you attend online appointments, you must ensure that you are in a private space where others cannot overhear your session without prior agreement.

7.5. In rare cases, we may be required by a court or other lawful authority to share clinical records. Where possible, we will inform you if this occurs.

8. Costs and Payment

8.1. Payment Terms

• Online bookings must be paid at the time of booking.

• Appointments arranged by email or phone will be invoiced after the session.

• Pilates classes must be paid in advance as a block.

You agree to ensure that your payment method has sufficient funds. If a payment fails, you remain liable for all outstanding fees.

8.2. Prices

• £65 – 45-minute new MSK physiotherapy assessment

• £48 – 30-minute physiotherapy follow-up / £65 – 45-minute physiotherapy follow-up

• £90 – 60-minute new pelvic health assessment

• £65 – 45-minute pelvic health follow-up

8.3. Additional Charges

• Phone calls longer than 15 minutes are charged at standard session rates.

• Letters and reports are charged at £25 per hour. Payment is requested via online link after completion.

8.4. Price Changes. Prices may change at any time but will not affect already-booked and paid sessions.

8.5. Insurance. We do not accept payment via private health insurance. We are not responsible for any insurance excesses, rejected claims or reimbursement decisions.

8.6. Late Payment. Invoices overdue by more than 30 days may incur interest at 5% per annum above Bank of Scotland base rate (or at a rate of 5% per annum for any period where the said base rate falls below 0%), accruing daily whether before or after judgment.. Treatment may be paused until payment is made without any liability to you. If debt recovery proceedings are required, you will be responsible for any reasonable costs incurred in recovering the debt.

9. Cancellation, Lateness, and Contract

9.1. Contract. A binding contract forms when your appointment is accepted and paid for. If you book an appointment on behalf of another person, you confirm that you have their authority to do so.

9.2. Consumer Rights. Under consumer legislation, where you have purchased a session from a distance (i.e. online and not in person) you have a right to a 14-day cooling off period. This means that once payment has been made, you have 14 days to cancel an appointment and request a full refund, provided no services have been performed during that period. If you ask us to provide services during the 14-day cooling off period, you acknowledge that you will lose your right to cancel once the relevant session has been completed, and you must pay in full for any sessions provided before cancellation.

9.3. Cancellations. Requests for cancellation must be made in writing to info@gvephysio.com. A failure to attend will be treated as a cancellation without notice.

• Cancellations made with more than 24 hours’ notice will be refunded in full.

• Cancellations with less than 24 hours’ notice are charged at the full session fee.

9.4. Lateness. If you are more than 15 minutes late, you may not be seen, and the full fee will apply.

9.5. Practitioner Cancellations. If we must cancel we will notify you by phone and/or by email, and you will be offered the earliest possible alternative appointment. No charge will apply. We will not be responsible for any additional costs you incur as a result of a practitioner cancellation.

9.6. Termination of Services. We may terminate services at any time if clinically or professionally appropriate. Where treatment is terminated due to safeguarding, health risks or professional concerns, we may provide a summary of concerns to appropriate authorities or healthcare professionals if required.

9.7. Amendments. We may revise these Conditions at any time. The version in force at the time of booking applies. You should check the last updated date at the header of this page to ensure you are reading the most up to date version.

 

10. Referrals

10.1. If we provide a referral to another health professional, you are responsible for arranging your appointment. We are not liable for services delivered by third parties.

10.2. We cannot guarantee the availability, waiting times or clinical decisions of third-party providers.

 

11. Professional Standard

11.1. We hold appropriate professional indemnity insurance.

11.2. Georgia van Embden holds a current Disclosure Scotland/DBS checks as required for clinical work in Scotland.

11.3. We are required to undertake regular CPD, maintain fitness to practise, and comply with mandatory reporting obligations to the HCPC.

11.4. If a conflict of interest arises, we will inform you and take appropriate steps to manage it.

 

12. Disclaimers

12.1. While we strive to provide effective, evidence-based physiotherapy tailored to your needs, we cannot guarantee specific outcomes. The effectiveness of treatment varies between individuals and depends on several factors, including your engagement, the nature and severity of your condition, your wider health, and external circumstances. We will review your progress regularly and adjust your treatment plan as clinically appropriate. However, it is important to understand that rehabilitation and recovery are inherently uncertain processes.

12.2. You are responsible for your own actions and decisions during and outside your sessions. Your participation in physiotherapy, including completing exercises and following clinical advice, significantly affects treatment outcomes. It is essential that you follow the agreed treatment plan and inform us of any difficulties, changes in symptoms, or concerns. We cannot be held responsible for consequences arising from your failure to follow professional advice or adhere to the treatment plan.

12.3. Active and honest participation is vital for successful physiotherapy. You are encouraged to communicate openly during your sessions and to tell us about any changes in your condition or personal circumstances that may affect your care. Decisions not to participate fully, including withholding relevant information or not completing prescribed exercises, may hinder your progress and are outside our control. Physiotherapy is a collaborative process, and its success depends on your commitment and engagement.

 

13. Limitation of Liability

13.1. We will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, loss of business, interruption to business, for any loss of business opportunity, or for any indirect or consequential loss arising out of or in connection with any contract between you and us.

13.2. Nothing in these Conditions seeks to limit or exclude our liability for: (i) death or personal injury caused by negligence (including that of its employees, agents or subcontractors); (ii) fraud or fraudulent misrepresentation; (iii) breach of the terms implied by Section 12 of the Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982; (iv) defective products under the Consumer Protection Act 1987; or (v) any other matter in respect of which liability cannot be excluded or restricted by law.

13.3. total liability to you for all other losses arising out of or in connection with the contract for sale between you and us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to directly foreseeable loss.

 

14. Indemnity

To the extent permitted by law, you agree to indemnify us against any loss, damage, or reasonable legal costs arising directly from your breach of these Conditions.

 

15. Severance
If any part of this contract is found invalid or unenforceable, the remaining provisions remain in effect.

 

16. Events Outside Our Control

16.1. Where an event outside our reasonable control occurs, this is considered a “force majeure event”. Such events include, but are not limited to, extreme weather, fire, flood, earthquake, natural disasters, failures of electricity or internet services, epidemics or pandemics, government restrictions or guidance, and failures by third-party suppliers or service providers.

16.2. If a force majeure event occurs, we are excused from performing our obligations under these Conditions for the duration of the event, and we will not be liable to you for any resulting delay or failure to perform. We will use reasonable efforts to resume our obligations as soon as we are able once the force majeure event has ended.

 

17. Third-Party Rights

Only you and we have rights under these Conditions. No third party may enforce it.

 

18. No Waiver

No failure or delay by us in exercising any of our rights under these Conditions shall be deemed to be a waiver of that right, and no waiver by us of a breach of any provision of these Conditions shall be deemed to be a waiver of any subsequent breach of the same or any other provision.

 

19. Entire Agreement

These Conditions, together with any documents expressly referred to in them, constitute the entire agreement between us in relation to the services we provide. They supersede and replace any previous agreements, representations, warranties, promises or understandings, whether written or oral, relating to the same subject matter. You acknowledge that you have not relied on any statement or representation that is not expressly included in these Conditions.

 

20. Severance

If any provision of these Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as removed from these Conditions. This will not affect the validity or enforceability of the remaining provisions, which will continue in full force and effect.

 

21. Data Protection

21.1. Your privacy and protection of your personal data is important to us. We are required to process your personal data when you engage us to provide services. This includes special category personal data. We will process your personal data in line with our obligations under the EU law retained version of the General Data Protection Regulation ((EU) (2016/679) and the Data Protection Act 2018.

22. Complaints

22.1. If you are dissatisfied, please raise the issue with us first.

23. Notices

All notices under these Conditions shall be in writing and served by email. We will use the email address associated with your account, and you can contact us at as info@gvephysio.com. You must keep your contact email address up to date, and notices sent to your last provided address will be treated as valid. Delivery by email will be regarded as completed at the time of transmission. This arrangement does not apply to the service of any documents in legal proceedings, which cannot be served by email.

 

24. Governing Law and Jurisdiction

These Conditions and any non-contractual obligations arising hereunder, shall be governed by, and interpreted according to Scots law and all disputes arising under these terms (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Scottish courts.

25. Contact Information and Communication

25.1. We prioritise each patient’s appointment and as such does not answer the phone whilst consulting. Emails are the most effective way to communicate.

25.2. Messages sent via social media, SMS or WhatsApp are not monitored continuously and should not be used in emergencies.
